In Ukraine, responsibility for violations in the field of personal data has been increased

On July 1, 2012, the Law of Ukraine «On Amendments to Certain Legislative Acts of Ukraine» entered into force on strengthening responsibility for violations of the legislation on personal data protection". This law was supposed to enter into force in January of this year, but then it was postponed until July.

The law obliges to obtain the consent of the subject before entering his data into the database, while the database of personal data must be registered with the State Service for the Protection of Personal Data.

Violation of the Law provides for fines from UAH 1.7 to 17 thousand, and in some cases criminal liability.

The law also provides for fines for failure to comply with the established procedure for personal data protection in the personal data base.

If the database of personal data is processed electronically, the only sufficient condition for ensuring protection is construction of a comprehensive information protection system (CSZI) , with mandatory receipt of the Certificate of Conformity. The certificate of conformity is issued based on the result of the state examination by the State Service for Special Communications and Information Protection of Ukraine. At the same time, registration of the database with the State Service for the Protection of Personal Data is mandatory.

The Scientific Research Institute of Applied Information Technologies for the Protection of Personal Data and Other Confidential Information Processed in the Information and Telecommunication System creates KSZI, which provides:

  • implementation of the information security policy adopted in the information system (IS);

  • confidentiality, integrity, availability of information during IS operation;

  • preventing the leakage of information with limited access and the loss of physical media containing the specified information;

  • organization of accounting, storage, circulation of information that needs protection, and material media on which it is stored;

  • availability of IS resources for authorized users.

The Institute develops a complete list of administrative documents necessary for the functioning of KSZI, and accompanies the system during the state examination until the customer receives the Certificate of Conformity .
